Red Lion Consulting: Foreign Investment and the Rule of Law
A webinar presented by RLConsulting members Sara Carnegie [CHAIR] and Mark Guthrie as well as panellists John F. This webinar will look at the following:
- The Rule of Law and the critical foundational role it plays for post conflict development.
- The importance of good governance in drawing in foreign investment, and how this should be perceived as a benefit rather than a hurdle in doing business.
- The independence of the judiciary and effective and efficient legal systems and procedures as being conducive to foreign investment and confidence in cross border commercial transactions.
- The relevance of the UN Guiding Principles on Business and Human Rights, ESG and mandatory human rights due diligence in attracting foreign investment in post conflict countries.
PANELLISTS
Sara Carnegie [CHAIR]
Sara Carnegie is an employed barrister with over 20 years’ experience working within the criminal justice system. She has spent the majority of her career working within the public sector in collaboration with government ministers, officials, the senior judiciary and law enforcement on a range of justice issues. She has led legal teams for two high profile public inquiries (the Baha Mousa Inquiry and Detainee Inquiry) and her immediate past role was Director of Strategic Policy for the Crown Prosecution Service in England and Wales.
Sara currently leads a team of lawyers running projects at an international NGO. Working with members and external stakeholders including the United Nations (notably the UNODC), the Organisation for Economic Co-Operation and Development (OECD), World Bank and European Union institutions, issues covered include anti-corruption, Judicial Integrity, Cybersecurity, Whistleblowing, Modern Slavery, Rule of Law, Bullying and Sexual Harassment, Gender Equality and Mental Wellbeing.

Mark Guthrie
Mark Guthrie has served in senior rule of law and human rights roles for the Commonwealth and OSCE. He has international legal and governance expertise with connections across judiciaries, governments, NGOs, and inter-governmental organisations. He has an in-depth understanding of the judicial and political systems across the OSCE and Commonwealth regions.
John F. Sherman, III
John F. Sherman, III, is a business and human rights expert and legal adviser.
From 2008 to 2011, John was part of the central team advising the Special Representative of the UN Secretary-General for Business and Human Rights, Harvard Kennedy School Professor John Ruggie, author of the UN Guiding Principles on Business and Human Rights.
Since 2011, John has been General Counsel and Senior Advisor to Shift, an independent non-profit that is the leading global centre of expertise on the UN Guiding Principles. John has worked with global fortune 500 companies, their legal departments, major international law firms and bar associations, on aligning their policies, processes and practices with the Guiding Principles, and is an internationally recognized thought leader on this subject.
Since 2011, John has also been a Senior Program Fellow at the Corporate Responsibility Initiative at Harvard Kennedy School, and an Executive Fellow at the Hoffman Center for Business Ethics at Bentley University.
John will be speaking here today in his personal capacity only.
Dominic Parker
Dominic Parker of Fitzrovian Africa will discuss the importance of good governance in drawing in foreign investment, and how this should be perceived as a benefit rather than a hurdle in doing business.
Dominic has worked across Africa on market entry, service development, capital raising and problem resolution projects, advising blue chip companies, financial institutions, high net worth individuals and family offices.
Andrew MacLeod
Professor Andrew MacLeod, Kings College London and Chairman of Griffin Law will discuss the Rule of Law and the critical foundational role it plays for post conflict development.
Professor MacLeod is an accomplished organisational leader in the for profit and not for profit sectors. He simplifies complexity, institutes change management, constructs diverse partnerships, and builds high performing, cross-cultural teams.
He has run major natural disaster operations (for the UN), led membership organisations (Committee for Melbourne), been critical in start-up to growth in sustainable investing fintech (Cornerstone Capital, Sendry), led award-winning practices (Griffin Law) and critical environment advice (Burnham Global and Risk Advisory Group). He is a Professor at Kings College London and a Council Member at Keele University. A leading communicator, MacLeod is effective on major TV networks globally, including BBC World and CNN. He is a master public speaker.
David Ziyambi
David Ziyambi is a member of the Latham & Watkins’ Finance Department and Africa Practice whose practice focuses primarily on project, structured, and leveraged financing in the energy and infrastructure sectors within both mature and developing markets, particularly throughout Africa. He represents sponsors, lenders, and governments on a range of matters, from project development and project finance deals to structured financing, prepayments, and reserve-based lending.
Faisal Siddiqui
Faisal is Deputy Chief Compliance Officer at the International Finance Corporation (IFC), the private sector arm of the World Bank Group. Faisal helps lead IFC’s Business Risk and Compliance Department, which focuses on integrity, regulatory, international tax, and other risks. Faisal also directly manages IFC’s integrity due diligence efforts (including anti-corruption, AML/CFT, and sanctions issues) and heads many of its crisis management teams. Most recently, he has co-led IFC’s response to the fall of The Abraaj Group, described by The Economist as the “biggest collapse in private equity history.”
Prior to IFC, Faisal was Managing Director at Fannie Mae, responsible for all compliance investigations for the institution. Previously, Faisal supervised the Administrative Law Division at the Export-Import Bank of the United States (Ex-Im Bank), where he managed Ex-Im Bank’s integrity, regulatory, compliance, litigation, ethics and corporate governance portfolios. Earlier in his career, Faisal practiced litigation as an Associate at Steptoe & Johnson PLLC and an Assistant Staff Judge Advocate in the Judge Advocate General (JAG) Corps of the United States Air Force.
