Barnaby Jameson KC appeared on ITV News on 18th August to set out the counter-terrorism laws applicable to proscribed organisations and those who provide them with support.

The group Palestine Action, which was recently proscribed as a terrorist organisation in the UK, has been at the centre of legal debate following reports that Irish author Sally Rooney has pledged to use proceeds from her work and her public platform in its support.

Key points from Barnaby’s outline of the law included:

• Section 17, Terrorism Act 2006 – inviting or expressing support for a proscribed organisation abroad applies only to UK nationals or residents. An Irish national ordinarily resident in the Republic of Ireland would not be caught by this provision (though Irish law may apply).
• Section 63, Terrorism Act 2000 covers terrorist financing offences and has wider reach. Anyone, regardless of nationality or residence, who funds a terrorist organisation from outside the UK in a way that would amount to an offence (if committed in the UK) under sections 15–17 could, in theory, be caught by UK law.
• In practice – prosecutions of Irish residents would more likely be brought under Ireland’s Criminal Justice (Terrorist Offences) Act 2005, but the UK legislation demonstrates potential extraterritorial application in cases of terrorist financing.
