Michael Goodwin secures acquittal of Abellio Surrey Ltd bus driver charged with a Health & Safety offence following the tragic death of a passenger. The driver had been unaware that an elderly passenger had remained on the bus after the last stop. He had driven her into the bus station.
After realising that the lady still remained on the bus, the driver had directed the passenger to exit the bus station via the safe pedestrian area. The passenger, however had walked through the bus parking bays and it was here she was run over and tragically killed by another double-decker bus, while it was reversing out of its bay.
The Health & Safety Executive charged the defendant with failing to take reasonable care in ensuring the passenger left the bus safely.
The defendant was cleared of the charge.
