RLC member Professor Laura Hoyano with co-author John Riley (23 ES) propose s28 pretrial cross-exam reforms to make it a more flexible and effective prosecution tool for vulnerable witnesses. They comment in Counsel Magazine:

“It is essential that system victimisation be minimised for these vulnerable witnesses by: solving the eligibility issues under the current statutory framework; extending eligibility to more witnesses who cannot be expected to endure the pressures of an already overloaded criminal justice system struggling to its feet due to COVID-19; and enabling prosecuting counsel to present their evidence most effectively in a flexible model of s 28 which includes examination in chief, which has been road-tested in other jurisdictions.”
