Three decades have passed since the enactment of the Criminal Procedure and Investigations Act 1996 (CIPA 1996), yet the challenge of establishing a fair and proportionate system for managing unused materials in criminal cases persists.
Writing in the April edition of Counsel magazine, Jonathan observes that while there is consensus regarding the solid structural framework outlined in the legislation, various issues arise in its practical implementation, particularly concerning digital evidence:
