Joanna Hardy-Susskind was invited by the “Cross Examination” Podcast to discuss miscarriages of criminal justice alongside barristers Max Hardy (9 Bedford Row) and host Tom Cross (11KBW).

The episode looked at:

  • what can go wrong, and has gone wrong with the criminal trial process
  • the flaws in the systems designed to provide redress for those failings
  • consideration of the case of Andy Malkinson, who spent 17 years in prison for a rape conviction held to be unsafe on appeal, whether lessons from his case should lead to change, and if so what that change should be
  • spoke to James Burley, the investigator in the Malkinson case whose crucial work led to Malkinson’s exoneration. Burley identifies what he believes are serious failings with the criminal appeal system
