Jonathan Fisher KC has authored a feature in Counsel’s June 2025 issue entitled “Disclosure for the Digital Age”.

In the article, Jonathan discusses his Independent Review of the disclosure process for unused material in criminal cases—submitted to Parliament in March. He highlights how the current system-still largely analogue-is overwhelmed by the surge of digital material in serious cases such as organised crime, fraud, rape and sexual offences.

Key points include:

-the urgent need to modernise disclosure procedures by harnessing technology—for example, AI-based tools to automate metadata extraction and produce searchable schedules
-simplifying manual redaction and reduction of administrative burdens, which currently slow investigations and court proceedings
-although the legal definitions underpinning disclosure remain sound, Jonathan stresses the importance of updating how the system operates in practice to ensure fairness and efficiency
