David Walbank KC instructed for the defence in multi-million pound ‘Loan Charge’ prosecution

David Walbank KC has been instructed in Operation Ginseng. The prosecution follows a major criminal investigation by HMRC into a number of tax professionals. They are alleged to have designed, promoted and run an avoidance scheme, which prosecutors claim was intended to evade the payment of tens of millions of pounds in tax due from individual taxpayers. The case arises from the Loan Charge provisions, which created a retrospective charge to income tax in respect of so-called ‘Disguised Remuneration’ schemes.

A charge of Conspiracy to Cheat H.M. Revenue & Customs has been sent for trial at the Southwark Crown Court.
