Aneurin Brewer interviewed by Al Jazeera

As a result of the recent successful appeal against conviction and subsequent acquittal of the asylum seeker Mr Kakaei establishing the section 11 defence in Small Boats Cases (see news story here) on Friday 18 June 2021 the CPS offered no evidence against eleven further asylum seekers at Canterbury Crown Court and discontinued a further pending prosecution against a twelfth asylum seeker.

Aneurin Brewer, who represented Mr Kakaei throughout, was interviewed by Al Jazeera and commented:

“the offence of assisting ‘illegal immigration’ is normally used to jail criminals who transport people into the country for profit….The irony and profound injustice of these cases is that the law that was enacted to protect people like Mr Kakaei has been used to prosecute him.”
