Felicia Davy KC secures acquittal following successful appeal against conviction

The defendant was originally convicted of manslaughter and perverting the course of justice following an alleged single punch to the head of a suspected shoplifter while working as a security guard at M&S.

He had always denied the allegations, maintaining that he acted in reasonable self-defence after threats to stab him were made. The incident, which was partially captured on CCTV, occurred after the defendant pursued two suspected shoplifters who had fled the store with stolen items.

Felicia successfully appealed the conviction, which was quashed on the basis of a failure to adequately sum up the case and a misdirection in law.

A retrial was ordered, at which Felicia secured the defendant’s acquittal.
