Boeing Plea Deal: Ed Vickers KC writes for US Law360

In his article for US Law Journal Law 360, Ed Vickers KC, analyses the proposed plea deal between US aerospace, airplane manufacturer and defence giant Boeing and the DOJ.

The deal, in which Boeing are due to plead guilty to a criminal charge of Conspiracy to Defraud, comes after US prosecutors decided that Boeing has failed adequately to meet the terms of the Deferred Prosecution Agreement (DPA) entered into in 2021, following airplane disasters involving the Boeing 737 Max aircraft in Indonesia in 2018 and Ethiopia in 2019, in which a total of 346 people died. Lawyers representing the victims and families of the disasters object to the plea deal and complain that Boeing has got away with full liability due to ‘crafty lawyering.’

Ed looks at the use of DPAs in the US and UK – and the use of whistleblowers – and stresses the need for corporates not only to act swiftly to cooperate with investigators and prosecuting authorities, but also to abide fully by the terms of the DPA to avoid further reputational damage.
