Anuerin Brewer appears before the Lady Chief Justice in the Court of Appeal

Aneurin Brewer appeared before the Lady Chief Justice in the Court of Appeal applying for leave to appeal conviction and sentence in a small boats manslaughter case.

The appeal concerned the first prosecution of a small boats pilot for manslaughter arising from the drowning of passengers when their inflatable capsized. Aneurin represented the defendant at both trial and retrial at which his client was eventually convicted by a bare majority of the jury of four counts of manslaughter and one of facilitating breaches of immigration law.

The grounds of appeal sought to challenge to trial Courts’ approach to the issue of causality in the context of the manslaughter counts where the passengers had consented to the risks of the crossing, as well as concerns over jury irregularities.

The Court reserved judgement on both applications.

The case was heard at Canterbury Crown Court and has attracted significant national media interest throughout.
