Alex Benn acts for defendant who has conviction and sentence expunged from record

Alex Benn represented a person who had been convicted of assault by beating.  At the initial trial, the District Judge found that there was no physical contact and convicted him of common assault, even though that offence had never been charged.  This error in law was compounded when, at a later hearing, a legal advisor amended the court record incorrectly.  Alex drafted an application to state the case to the High Court to correct the two errors.  Unusually, the District Judge decided to revisit the case. She agreed that she was in error and used an unusual part of the “slip rule” to expunge the conviction and sentence.
