
Riel Karmy-Jones KC has successfully represented the Prosecution in appeal proceedings, ensuring an extended sentence of 25-years imprisonment for manslaughter (comprising a custodial term of 21 years and an extension period of 4 years) remains upheld.
Rafal Winiarski was convinced that his wife Malgorzata Lechanska had been having an affair, and had placed surveillance cameras around their home. On the afternoon of the killing she returned home from grocery shopping and was unloading her bags when he launched a brutal attack upon her, using a knife and an axe, and with their 7 year old daughter playing outside. Malgotzata was declared dead at the scene by paramedics, having suffered severe head and body injuries.
Mr Winiarski was originally charged with murder, but after a number of psychiatric assessments found him to be suffering from a delusional disorder, he pleaded guilty to Manslaughter on the basis of diminished responsibility.
